PREAMBLE

Fun Sport S.L. (hereinafter, THE WEBSITE OWNER) is engaged in the business of wholesale distribution of cycling products. To begin the purchasing process, the User must register on the website http://b2b.funsportexpress.com. These General Terms and Conditions of Sale apply to purchases made through the aforementioned website of THE WEBSITE OWNER.

DEFINITIONS

Website: the website http://b2b.funsportexpress.com. USER(S): any natural or legal person placing orders for one or more services or products through the Website. PRODUCT(S): the products offered for sale on the Website. GENERAL TERMS AND CONDITIONS OF SALE: the set of clauses forming these General Terms and Conditions of Sale, which apply to any order made through the Website.

ENFORCEABILITY OF THE GENERAL CONDITIONS

Placing an order implies full and unconditional acceptance by the User of these General Terms and Conditions of Sale. In the absence of express acceptance, any opposing conditions proposed by the User shall not be enforceable against THE WEBSITE OWNER, regardless of when they may have been communicated. PURCHASE PROCESS

The User will purchase Products from the Website. By clicking the "Pay" button during the purchasing process, the User declares full and unconditional acceptance of all the General Terms and Conditions. Contractual information will be presented in Spanish and will be confirmed no later than at the time of delivery. SERVICE AVAILABILITY

THE WEBSITE OWNER will do its best to satisfy User demand for Products. However, sometimes due to circumstances beyond control such as human error or system incidents, a product may be unavailable. In case a product becomes unavailable after an order has been placed, the User will be informed by email of the cancellation. The speed with which the refund is credited back to the User’s account depends on the type of bank card or payment system used.

ORDER CONFIRMATION

With acceptance of these General Terms and Conditions of Sale and once the purchasing process is confirmed, the order is formalized. At this moment, THE WEBSITE OWNER will send the User an email confirming the details of the purchase made, including identification of products and services purchased and their price.

PRICE AND PAYMENT

All Product prices indicated on the Website once logged in as a registered customer do not include VAT nor shipping costs. They also do not include other applicable special taxes. THE WEBSITE OWNER reserves the right to modify its prices at any time, but products will be invoiced based on rates in effect at the time the order is registered. Products remain property of the supplier until the price is fully paid.

Payment is made by credit card. Accepted cards are: Visa and MasterCard. The purchase amount will be charged to the customer’s bank account within 4 days from the order date and will be validated after bank authorization. If the POS terminal reports a declined card, the order will be automatically canceled and the customer will be notified online.

Payment may also be made by bank transfer or bank draft according to the payment terms agreed with the customer.

SECURITY

For your security, THE WEBSITE OWNER has entrusted its payment system to SERMEPA via its payment gateway. Bank data entered is encrypted and securely transmitted to the bank’s servers and then verified by the issuing bank to prevent fraud and abuse. DELIVERY

The supplier will send the products to the distribution warehouse, from where they will be shipped to the address indicated by the buyer. Shipping costs will be borne by the buyer. THE WEBSITE OWNER will request the delivery address, which may be a home, office, or designated location, where the product will be received within approximately 24–72 hours from receipt of the order at the distribution warehouse. Delivery times will be longer for shipments to Canary Islands, Ceuta, Melilla or abroad. THE WEBSITE OWNER will notify the client of shipment via email. Each delivery is deemed made once the product is made available to the client by the carrier. It is the recipient’s responsibility to check the order upon delivery and make any justified claims or reserves, or reject the package if it appears opened or damaged.
